Bankruptcy and Mortgage Loan?
Tarheels asked:
If my fiance files bankruptcy how does that affect our mortgage loan, we are not behind on it at all and don’t want it to be effected.

You should discuss that with a bankruptcy attorney “before” she files to see what your options are, because once she files, the bank legally may not be able to discuss it or send statements.

It would depend on what can be worked out. I would get with a bankruptcy attorney to see what can be done. The other issue here is that if the fiance does file, your talking at least 2-3 years that they can apply for a mortgage, and that’s assuming they’ve rehabbed their credit. If you try to refi or buy, you will have to do it on your own, the bankruptcy will be a big red flag to the lender. Good luck
